The current version of the Program Operation Manual System, used by the Social Security Administration to prorate lump sum settlements, should always be consulted before a workers' compensation settlement is structured. Justice Imperiled is the story of the brilliant lawyer Max Hirschberg, one of Germany's most courageous defenders of justice in the face of Hitler's rise to power.

Hirschberg lived an extraordinary life at a defining moment in German and European history. Sharon worked as a nurse in both acute and long-term care settings prior to attending law school. In 1986, she graduated magna cum laude from The University of Notre Dame Law School. She has practiced law since that time and is licensed in Maryland and the District of Columbia.

Sharon is a member of the Million Dollar Advocates Forum, an organization that recognizes lawyers who have achieved million dollar verdicts or settlements for their clients. In addition, she is AV rated, the highest ranking possible in the Martindale-Hubbell Law Directory. In 2003, Sharon received the Judith P. Ritchey Achievement Award, presented by the Baltimore County Bar Association. In 2008, she was named a Maryland SuperLawyer in Baltimore Magazine.

Sharon is a frequent lecturer to professional and community groups. She has given talks on Social Security Disability Law, Neglect and Abuse in Long Term Care Facilities, Nursing Malpractice, Medical Malpractice and Personal Injury Law.

* You can answer most cross examination questions with a simple statement of fact. Alternatively, you can respond with the following simple expressions: "yes," "no," "I don't know," "I don't recall," and "I did not understand your question."

* Never ramble on in your answers. Only provide in your answer what the question requests.

* Never answer questions with phrases that express uncertainty or that begin with, "I guess," "I believe," "I presume," or "I think." Do not hedge your opinions in court the way you might at a party or in coffee conversation with friends. Your expertise and your science should enable you to draw opinions and present opinions that are proper to a reasonable degree of medical or scientific certainty, based on the technical evidence and your work. Answers that begin with technically shaky phraseology will not meet the legal burdens of proof required in a court of law.

* Leave some leeway when relating a series of events, or a list of facts. Do not simply say "that's everything"; instead, say something like "that's all I recall right now."

* Permit the lawyer to finish his question completely. Also wait for one to two seconds before answering. In addition to providing your attorney with an opportunity to object to or comment on the question, this will give you a bit of time to Think of a question and answer to your best.

* Finally, to avoid sounding arrogant or disrespectful, or making jokes or remarks heart light. Can be very easily turned around by your lawyers.

Uh oh! You've just been pulled over, you see the intimidating red and blue lights flashing behind you and your heart begins to pound, and your nerves start acting up. Even for the most law abiding, vigilant driver getting pulled over can be a very stressful event. Hopefully we can help you out with this article so you can avoid getting a serious infraction, hopefully getting an officer to get you off with a warning.

So You've Been Pulled over. Now what?

Getting pulled over doesn't have to be a extremely distressing experience, if you've been driving over the speed limit, your registration has been expired or even if you've had a few too many beers at your local dive and you got behind the wheel, there are several things you can do to avoid getting a charge, or having the officer let you go with a warning.

Police officers are human beings and have very difficult jobs, the general rule is be as polite as possible and helpful as possible-without incriminating yourself-and there may be a high probability that you can get off with a warning and without further consequence.

Pulling over into a Safe Area

When you get pulled over, make sure you pullover quickly but at the same time into a reasonable and safe area. When you see lights flashing behind you it's a good rule of thumb to pull over promptly but also to pullover into a place that would not put the officer in danger. If you do not give the officer of the room on the shoulder or on the side of the road-he runs the risk of being hit-and he may not get out of that vehicle, instead instructing you with the loudspeaker to pullover into the right shoulder, and then he may have to negotiate traffic to try to cross the highway. This is definitely starting off on the wrong foot, the goal is not to not to piss the officer off but rather to make the officer's job easier, in turn helping the chance of you getting off with just a warning.

Don't Take Forever to Pullover

Even though it's important to pullover into a safe area it's not a good idea to coast for several blocks before pulling over. Pullover promptly into a safe area does not to jeopardize the officer's safety or your own, but don't coast for several blocks letting the officer follow you like some lost puppy. Remember that police officers are also involved with dangerous suspects and when somebody coast for several blocks the officers think that either, you're trying to hide something or you're intoxicated. He has no idea what you're doing; form stashing something under the seat to trying to get empty beer bottles into the trunk or growing a blanket over a dead body, he has no clue. He has better to be safe then sorry, pullover quickly but pull over safely.

What to Do When He Comes to the Window

Here's where your soft skills will come in handy, it takes some interpersonal relationship building skills sets to negotiate your way and manage to drive away from a potentially financially draining traffic ticket. There are some conflicting reports from authoritative sources about this next particular issue; whether or not to keep your engine running when you get pulled over.

Based on several interviews with DUI lawyers, police officers here in San Diego it is a good practice to keep your hands on the steering wheel and keep your engine off. Officers are dealing with cars that are barely functional, because those cars most likely have broken tail lights, expired registrations or smoke billowing out of the exhaust They've come across plenty of vehicles that didn't start after the individual cutoff the engine.

Another thing you should do when officer pulls you over is keep your hands on the wheel. That shows the officer that you know proper traffic etiquette when pulled over, and it puts the officer at ease, due to the fact that you're not reaching around in your glove compartment box or center console with for a gun. Most likely you are searching for your license, registration and insurance information but the police officer has no clue.

Another biggie is staying in the vehicle, which may sound like common sense but a lot of individuals who feel that they have something important to say or have to be somewhere in a hurry to feel like they need to jump out all the vehicle and explains the officer exactly what's going on. That's a bad move, if you're jumping out of the car the police officers thinking that they have something to be afraid of, have awards, or whacked out on drugs possibly intoxicated.

Speak When Spoken to; Practice Discretion

Being polite to the officer definitely helps, some people can pull off a iffy sound a little too cheesy it may sound like you have something to hide the best thing to do is to say less, and only answer questions with neutrality and vagueness when. Police officers are used to rudeness, filing complaints at all types of people. You can just about get away with saying anything short of using curse words and aggressive way or being physical. If you use a curse word in an aggressive way in some states that could get you a disorderly conduct charge.

Georgia's new law limits the asbestos lawsuits

May 1, 2007 - With a quick stroke of his pen, Gov. Sonny Perdue approved a new bill that will limit asbestos lawsuits strictly to those demonstrating illness.

Sponsored by State Senator John Wiles (R-Marietta) and endorsed by Georgia's Trial Lawyer Association, it aims to clear court dockets by allowing priority for cases where the plaintiff can definitively prove illness from asbestos exposure. Wiles said of the bill, "This would allow people that are truly sick to move to the front of the line."

Before passage of the law, a lawsuit could be filed if a person was exposed but did not have a confirmed diagnosis of an asbestos related condition. The number of cases generated lead to legal critics consistently arguing that asbestos litigation was creating an avalanche of junk lawsuits.

A recent study found that in the United States alone more than 730,000 asbestos lawsuits had been filed through 2002 and at least 8,400 defendants have received more than $70 billion. Georgia bears a number of these lawsuits as it is home to the headquarters of the Georgia-Pacific company which has long been a target of asbestos lawsuits.

Asbestos was commonly used for insulation and fireproofing before the 1980s when its health risks began to emerge. It is a carcinogen when inhaled and exposure can lead to the often fatal disease mesothelioma. Asbestos exposure related diseases generally take 20+ years to develop and patients are often diagnosed when they are in the advanced stages.

This is not the first time the state has moved to try and limit asbestos lawsuits. An earlier law was dismissed by The Georgia Supreme Court in 2006 and the new law is expected to be challenged as well.

The new law is similar to measures enacted in Ohio, Florida, Texas, Kansas, South Carolina and Texas. A person filing a claim in Georgia must demonstrate that they have some physical impairment from exposure to asbestos. Others who were exposed to Asbestos Is not be able to sue until they became ill, under the law.

Each of the 50 states have laws that vary when it comes to how they process DWI cases. There is a blood alcohol level that is used to determine who is breaking the law and who has drank less than the legal limit before getting behind the wheel of a vehicle. Most states use a blood alcohol level of .08 but some of them are as low as .05. The blood alcohol for commercial drivers and airline pilots is even lower at only .04.

The laws relating to DWI state laws changed significant during the 1980's. Before that period it was possible for the blood alcohol limit to be .12. The legal drinking age was changed in 1989 from 18 to 21 and at that time most states initiated laws for DWI regarding any alcohol for someone under the legal drinking age.

If you have a very high blood alcohol level from .15 to .20 then you can face even stricter charges in many states. Having that high of a blood alcohol level can be very serious because you are at a high risk of passing out behind the wheel of the vehicle. Anyone who drives while they have been consuming alcohol can have impaired vision, judgment, and reaction times. This can lead to serious accidents and even fatalities.

Some people have a hard time with the stricter laws for higher blood alcohol levels. They hold the position that if the person is able to consume that much alcohol they simply have a higher tolerance for it that has occurred over the years. Some even feel they are less of a risk on the roads than someone who rarely drinks. Proving this issue one way or the other is almost impossible though.

Being charged with a DWI is a serious issue regardless of which state it occurs in. DWI is a misdemeanor in all 50 states but it can be upgraded to a felony charge if there is a high blood alcohol level or there is an accident If someone is seriously injured or they are killed then the charges are generally much stiffer. It can also become a felony DWI charge if the person has one That one incident.

From the supplier: The purpose of the Social Security Disability Benefits Reform Act of 1984 was some uniformity in federal courts' evaluation of pain and other subjective complaints in disability cases. Inconsistency remains in the first step of this process, now the courts decide whether a medically determinable impairment exists. This problem stems from the widespread recognition of legitimate conditions that may be disabling although frequently not supported by objective medical evidence. Congress should address this matter either by affirming its earlier position or developing an alternative statutory procedure for establishing a medically determinable impariment.
